Liability and Insurance

The Harvard Depository takes extensive precautions to assure the safety of all material in storage and in transit to and from clients.

  • Material of clients who are Harvard Departments ("tubs") is covered for third party claims by Harvard's general liability insurance policy; the Depository does not maintain any separate insurance against liability, loss or damage with respect to material stored at the Depository, or in transit to or from the Depository.
  • Material of non-Harvard clients is not covered by Harvard's liability or property insurance policies and must be covered by these clients' own institutional policies. Non-Harvard clients must provide the Depository, upon execution of the initial storage and service agreement, with a copy of the client's current general liability and property insurance policies naming the Depository as an additional insured before any materials can be transferred to the Depository.
  • The Depository is not responsible for replacing any lost or damaged material stored in the Depository or transferred by the Depository or for the value thereof, or for any indirect, incidental and/or consequential damages arising from the loss of or damage to material stored in or transferred by the Depository.
  • Harvard Library is not responsible for damage to or loss of any material while held at the Harvard Depository or during transfer from or to the owner.
  • In no event will any monetary amount be paid by the Depository to the owner of damaged material, regardless of the cause of the damage.
